No sooner had it reached a court settlement with SumTotal than IPLearn LLC has filed suit against Learn.com, Certpoint Systems Inc., Meridian Knowledge Solutions LLC, NetDimensions Ltd., ND Services Inc., Emtrain, HRSmart Inc. and Perot Systems Corp.
IPLearn and SumTotal reached their agreement on March 15. The subsequent suit was filed against the eight LMS companies on March 19.
IPLearn holds U.S. Patent 5,967,793 for “Relationship-Based Computer-Aided-Educational System,” which describes a way for students to learn a new subject based on its relationship to subjects they already know -- in other words, what learning professionals generally term “adaptive learning.” According to some sources, a major Supreme Court decision is pending about the validity of this genre of business process patent.
IPLearn’s newest patent infringement case was filed in the Tyler Office of the Texas Eastern District Court. The plaintiff has requested a jury trial.
The IPLearn/SumTotal litigation was pending in the U.S. District Court for the Northern District of California since 2002. Under the terms of the settlement agreement, SumTotal, will pay IPLearn $3.5 million over three years and issue it 50,000 shares of common stock.
